Work permit and work visa (employer-sponsored)
WorkIndians can do paid work in Azerbaijan only after an employer there obtains a work permit for them from the State Migration Service; the ASAN e-visa does not allow paid work, so a work visa is needed, and anyone who will live and work there also needs a temporary residence permit.
- Worker must be over 18 and able-bodied
- The employer applies: a legal entity, an individual entrepreneur, or a branch or representation of a foreign legal entity; signing a labour contract without a work permit is prohibited
- The job must be a vacancy no qualified Azerbaijani citizen has applied for, which employment services cannot fill from local labour
- Employer submits: application form, copy of the worker's passport, notarized qualification document, reference justifying the hire, employer's notarized registration documents, and a certificate that the worker is not a carrier of HIV, Hepatitis B or Hepatitis C
- Processing time depends on the state fee paid under the Law 'On State Fee'; the permit is handed to the employer after the fee is paid
- Work permit is issued for 1 year (or the contract term if shorter) and can be extended each time for up to 1 year; the employer must apply for extension at least 30 days before expiry
- Work visa: stay of up to 90 days; those staying to live and work need a temporary residence permit in addition to the work permit
- If the work permit becomes invalid and there is no other ground to stay, the worker must leave within 10 working days
- No work permit needed for some groups, e.g. permanent residence permit holders, entrepreneurs, spouses of Azerbaijani citizens registered in Azerbaijan, university professors and lecturers, and highly skilled migrants working in their field
